Do the frozen yogurt machines need to be <\/span><em><span style=\"color: #000000; font-size: medium;\">toiveled<\/span><\/em><span style=\"color: #000000; font-size: medium;\"> or even any of the pieces that can be removed need to be <\/span><em><span style=\"color: #000000; font-size: medium;\">toiveled<\/span><\/em><span style=\"color: #000000; font-size: medium;\">?<\/span><\/span><\/p>\n<p><span style=\"color: #000000; font-family: Calibri; font-size: medium;\">\u00a0<\/span><\/p>\n<p><span style=\"font-family: Calibri;\"><em><span style=\"color: #000000; font-size: medium;\">Hatzlacha<\/span><\/em><span style=\"color: #000000; font-size: medium;\"> on your new venture.<\/span><\/span><\/p>\n<p><span style=\"font-family: Calibri;\"><span style=\"font-size: medium;\"><span style=\"color: #000000;\">This is a fascinating and difficult question. On one hand, assuming there are metal pieces coming in direct contact with the food being prepared, there should be an obligation to <em>toivel<\/em><\/span><\/span><span style=\"color: #000000; font-size: medium;\"> it <\/span><em><span style=\"color: #000000; font-size: medium;\">miD\u2019Oraisa<\/span><\/em><span style=\"color: #000000; font-size: medium;\">. Furthermore, unlike <\/span><em><span style=\"color: #000000; font-size: medium;\">kashering<\/span><\/em><span style=\"color: #000000; font-size: medium;\"> where the primary concern relates to the impact of the utensil on the food, which would not be an issue when it is anyways not being sold as Kosher, <\/span><em><span style=\"color: #000000; font-size: medium;\">tevila<\/span><\/em><span style=\"color: #000000; font-size: medium;\"> is different. Since the primary obligation of <\/span><em><span style=\"color: #000000; font-size: medium;\">tevila<\/span><\/em><span style=\"color: #000000; font-size: medium;\"> is incumbent upon the user prior to his usage of the object, it should be irrelevant who the customers are. In this case, since a Jew, you, are intending to utilize this equipment, it should require <\/span><em><span style=\"color: #000000; font-size: medium;\">tevila<\/span><\/em><span style=\"color: #000000; font-size: medium;\">.<\/span><\/span><\/p>\n<p><span style=\"font-family: Calibri;\"><span style=\"font-size: medium;\"><span style=\"color: #000000;\">However, the <strong>Shulchan\u00a0Aruch<\/strong><\/span><\/span><em><span style=\"color: #000000; font-size: medium;\">Yoreh\u00a0Deah<\/span><\/em><span style=\"color: #000000; font-size: medium;\"> 120:8 provides that only usage for preparing or serving food obligates <\/span><em><span style=\"color: #000000; font-size: medium;\">tevila<\/span><\/em><span style=\"color: #000000; font-size: medium;\">, but a knife designated for cutting paper is exempt. The main question would be if we can classify preparing food exclusively for non-Jews as an exempt usage. I had the opportunity to present this question to <\/span><strong><span style=\"color: #000000; font-size: medium;\">HaRav\u00a0Zalman\u00a0Nechemia Goldberg<\/span><\/strong><span style=\"color: #000000; font-size: medium;\">\u00a0(HaRav\u00a0Shlomo Zalamn\u00a0Auerbach zatzal\u2019s son-in-law and the former Av Beis\u00a0Din of the Rabbanut\u2019s Beis Din HaGadol) last week, and he found this logic a likely possibility. Unfortunately, we were unsuccessful in locating any source for such a distinction, and he was unwilling to commit to accepting the classification of solely gentile consumption as a non-food usage that would exempt it from <\/span><em><span style=\"color: #000000; font-size: medium;\">tevila<\/span><\/em><span style=\"color: #000000; font-size: medium;\">. He repeated a number of times \u201cIt sounds good, but\u2026\u201d Even when I pressed him to take into account the Poskim who consider an electrical appliance an exempt item due to its connection to the ground, he remained noncommittal.<\/span><\/span><\/p>\n<p><span style=\"font-family: Calibri;\"><span style=\"font-size: medium;\"><span style=\"color: #000000;\">In conclusion, it seems that you must <em>toivel<\/em><\/span><\/span><span style=\"color: #000000; font-size: medium;\"> whatever parts of the machinery are obligated in <\/span><em><span style=\"color: #000000; font-size: medium;\">tevila<\/span><\/em><span style=\"color: #000000; font-size: medium;\">, but certainly without a <\/span><em><span style=\"color: #000000; font-size: medium;\">bracha<\/span><\/em><span style=\"color: #000000; font-size: medium;\">. Certainly, if you expect to occasionally eat the frozen yogurt yourself relying on your personal knowledge that it is truly Kosher, you are absolutely required to <\/span><em><span style=\"color: #000000; font-size: medium;\">toivel<\/span><\/em><span style=\"color: #000000; font-size: medium;\"> it. If you wish to know which specific parts require <\/span><em><span style=\"color: #000000; font-size: medium;\">tevila<\/span><\/em><span style=\"color: #000000; font-size: medium;\">, you will have to send me a diagram or photo of the machine.<\/span><\/span><\/p>\n<p>&nbsp;<\/p>\n<h1>Addendum<\/h1>\n<p>&nbsp;<\/p>\n<p>I sent this question to a number of acquaintances who work for various Kashrus organization to hear their policies. I received the following response from Rabbi Eli Gersten of the OU:<\/p>\n<p>The OU arranges a mechira of 2% of the machine to a non-Jew. And it is then borrowed\/rented back from the non-Jew.<\/p>\n<p>We write up a shtar and do various other kinyanim as well (Kesef, suddar, agav, chatzer, and situmta (handshake).<\/p>\n<p>The 2% is enough to create a shutfos but yet not enough that the non-Jew will decide to walk off the machine. It also makes for a manageable price.<\/p>\n<p>In restaurants there are many machines that require this eitza, because they are too heavy or they will break if toiveled.<\/p>\n<p>&nbsp;<\/p>\n<p>My Shver, Rabbi Reuven Drucker, the Rav of Agudath Israel of Edison\/Highland Park, NJ and Rabbinical Board member of the Vaad HaKashrus of Raritan Valley related to me that their policy is to require Tevilla even for large equipment. Only as a last resort will they rely upon a sale similar to the OU.<\/p>\n<p>&nbsp;<\/p>\n<p>Rabbi Mordechai Frankel of the Star-K responded:<\/p>\n<p>As you mentioned, there are a number of sevoros to be lenient. Those who are meikel do so because a kli which is 40 se\u2019ah big is tofeis reshus le\u2019atzmo, so I don\u2019t think that the size of the bies kibul matters. See Rav Shlom Kluger \u05e9\u05d5&#8221;\u05ea \u05d8\u05d5\u05d1 \u05d8\u05e2\u05dd \u05d5\u05d3\u05e2\u05ea \u05de\u05d4\u05d3\u05d5&#8221;\u05d2 \u05d7&#8221;\u05d1 \u05e1\u05d9&#8217; \u05db\u05d1.<\/p>\n<p>Therefore, there are clearly sevaros lehakel.<\/p>\n<p>&nbsp;<\/p>\n<p>In response to my question what they would do l&#8217;Maaseh, I forwarded him the link from Shimon Rottenberg and he showed a picture of the machine to Rav Heinemann.
